What this Privacy Notice covers
Your privacy is very important to South Holland District Council.
South Holland District Council is the Data Controller responsible for the personal information you may provide in relation to a Licensing Application. Your data will be processed by Public Sector Partnership Services Ltd (PSPS), formerly known as Compass Point Business Services, a company owned by East Lindsey and South Holland District Councils. Also, as a Responsible Authority under the Licensing Act 2003, Gambling Act 2005 and Finance Act 2011 applications and information will be shared to ensure that the legislative obligations are met under the Act to external agencies such as Trading Standards, Children's Services, Planning Authority, Fire and Rescue, Public Health, Police, Home Office, Maritime and Coastguard Agency, HMRC, Gambling Commission, DEFRA, Environment Agency, Nominated vet, Other Local Authorities and/or the Disclosure and Barring Service.
Why we need your personal data
When you contact us to access our services, apply for a licence, registration or permit or we contact you as part of an investigation, we may ask for certain personal information in order to be able to assist you or to investigate fully. Some of this information will be recorded and stored on our systems.
When you apply for a licence, registration or permit we require a range of details including name, contact details, such as your address, email address and telephone number. In some cases we also require national insurance number, birth details, bank account details (scrap metal dealers), address history, current employer and employment history. If you choose not to supply the required information we will not be able to progress the application.
Right to work in the UK
Personal and premises licence holder applicants and taxi driver applicants are required to submit documents to prove that they have the Right to Work in the UK. These documents will include nationality and residence information.
Taxi and scrap metal dealer licensing
To ensure that applicants can be considered to be fit and proper, background checks are required and the Disclosure and Barring Service will be issued with a request for the criminal conviction history of each applicant.
A medical assessment is also required from the driver applicant's GP and this may contain personal information regarding medical conditions.
We will gather this information because it is in the public interest to provide information for safeguarding the public. If you choose not to supply the requested information, we will not be able to progress an application or renew a licence.
The legal basis for processing your data is Article 6.1(c) of the General Data Protection Regulations, namely that processing is necessary for compliance with a legal obligation to which the Council is subject and Article 6.1(e) of the General Data Protection Regulations, where processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
The relevant Legislation is the Licensing Act 2003, Gambling Act 2005, Dangerous Wild Animals Act 1976, Breeding of Dogs Act 1973 (as amended by the Breeding and Sale of Dogs (Welfare Act) 1999), Pet Animals Act 1951, Riding Establishments Act 1964 and 1970, Zoo Licensing Act 1981, Animal Boarding Establishments Act 1963, Scrap Metal Dealers Act 2013, Highways Act 1980, Local Government (Misc) Provisions Act 1976 and 1982, House to House Collections Act 1939 and the Town Police Clauses Act 1847.
Where it is necessary to process special categories of personal data, such as your birth details which reveal your racial or ethnic origin, safeguarding issues and your health details, these are processed under Article 9.2(g) where there is a substantial public interest to safeguard the fundamental rights and the interests of the data subject.
How we use your information
We will use this information to process applications, remind licensees of renewals and investigate complaints.
Certain information such as your name may also be published on the licensing public register.
When and why we share your information
We do not share your information with anyone else unless we are required to do so by law or it is necessary to provide our services to you.
Below is a list who we may share your information with:
- Trading Standards, Children's Services, Planning Authority, Fire and Rescue, Public Health, Police, Home Office, Maritime and Coastguard Agency, HMRC, Gambling Commission, DEFRA, Environment Agency, Nominated vet, Other Local Authorities and/or the Disclosure and Barring Service.
The Council may use your information for the purpose of performing any of its statutory enforcement duties. It will make any disclosures required by law and may also share your information with other bodies responsible for detecting/ preventing crime including fraud or auditing/administering public funds.
How long the information is kept for
The information we collect is carefully stored electronically. We will hold completed application forms and supporting documents during the lifetime of the licence. Once the licence has lapsed, been surrendered or revoked it is retained for six years.
