Dangerous Trees



How we provide this service

To give consent and/or advice on procedures to follow if a protected tree is suspected of being in a dangerous condition. This service is supported by Planning and Development, Conservation Team.

If you need to carry out works to a protected tree which is in a dangerous condition, please contact the District Council where possible, giving at least 5 days notice. In cases of an emergency, you may carry out the minimum works necessary to make a tree safe without contacting the Council, but you will have to prove without doubt the condition of the tree, and why it needed immediate action.

Should you propose to do works to improve the safety of a tree, and the tree does not appear to be in an eminently dangerous state, contact the Council for a site visit and protected works form (see entry under Protected Trees).

You may need an independent expert's opinion, such as a qualified arboriculturalist, to back up your proposal.

What to do to get this service

If you believe a protected tree to be dangerous, then contact the Council directly for advice. If you need to make the tree safe when the Council is not contactable, then you may do the minimum work necessary to make the tree safe until the Council can be reached. The onus is on the defendant to prove that the tree was dangerous. Photographic evidence may be suitable if the tree is obviously unsafe, or a report on the condition of the tree by a qualified arboriculturalist.

Who can apply?

Anyone can contact the Council if they suspect a tree is in danger of harming someone.

How long will the whole process take?

If the tree is an immediate danger, then it will be actioned within 48 hours if possible.
