Planning Applications - infringement



How we provide this service

Infringement of planning applications is supported by Planning and Development, Planning.

We have an experienced enforcement team who are used to dealing with the smallest infringement, such as a conservatory or garden wall, to a major event such as a unauthorised developments both residential and commercial.

We also monitor conditions of a planning permission to ensure they are met in accordance with that permission.

If we come across any breach we will start an investigation by writing to the offender making them aware that the breach has come to our attention. In most cases this is enough for the offender to correct any mistakes they have made that led to the breach of planning laws.

In some cases however, after an investigation, we may have to serve an enforcement notice. This notice could require many different things but in general it would require the offender to put right the breach, it may require preventative measures or it may require the offender to return the site in question to its former state.

In severe cases, if the enforcement notice is not complied with by the offender, it will end up in the magistrates court. Breach of an enforcement notice is a civil offence and is punishable by the courts by fines or even imprisonment.

It is essential that if you are aware of any potential breach of the planning laws, for example if you have seen someone building an extension (or house!) that you do not believe has the benefit of planning permission, you contact customer services immediately.

We will then start an investigation. Any one who reports a potential breach in planning is kept anonymous from the alleged offender and under no circumstances are their details revealed to any one other than the investigating team.
