Change of tenancy



How we provide this service

Council Tenants - change of tenancy

At some point during your tenancy you may need to apply to change the name on your tenancy agreement. For example:

- after a marriage
- after a name change
- as a sole tenant you may apply for a joint tenancy.

As a secure tenant you also have the right of succession (to pass on your home) and the right to assign (to pass on your tenancy to another person).

This service is is supported by Housing, Operational.

What to do to get this service

Joint tenancy

We will consider a request for a joint tenancy if:

- there has been no previous succession or assignment or the current tenancy
- there are no rent arrears outstanding
- the proposed joint tenant has lived in your home for at least 12 months and is at least 18 years old
- your home is not under-occupied.

Right of succession

In certain circumstances after your death, a member of your family may be able to take over your tenancy. This is known as a succession. The following people could succeed to your tenancy:

- any surviving joint tenant/s if they occupied your home as their principal home at the time of your death
- your spouse or person living with you as husband or wife (including same sex partners) provided they occupied your home as their only principal home at the time of your death
- if you have no surviving spouse, partner or joint tenant/s, a member of your family may succeed as long as they occupied your home as their only principal home and live with you throughout the period of 12 months ending with your death.

Right to assign

An assignment is where you pass on your tenancy to another person. You can only pass on your tenancy in certain circumstances:

- in the event of a court order where a relationship has broken down
- if you want to transfer the tenancy to a person who could legally take it over if you die. In this situation the assignment will count as a succession and there will be no further right to pass on the tenancy.

All applicants will need to fill in an application form and supply the documentation requested on the bottom of the form.

How long will the whole process take?

Once we have received your application form and any necessary documentation, we will normally process your application within 10 working days. In some cases, we may take a little longer.
