Part 8 - Glossary of Terms

In this Constitution, unless the context otherwise demands, the following terms have the meaning assigned to them:

"authority" - the South Holland District Council acting by any means which they may lawfully adopt;

"cabinet" - six elected members appointed by the Leader and who, with the Leader, form the Cabinet.

"call-in" - The consideration by either of the Policy Development or Performance Monitoring Panels of a decision made but not yet implemented, which may result in the recommendation that the decision be reconsidered by the person or persons who made that decision or that full Council be recommended that the decision be reconsidered in accordance with Section 21 (2)(a) and (3) of the 2000 Act.

"chairman" - the person appointed to preside at meetings of any properly constituted body.

"Chief Executive" - the Chief Executive for the time being or such person as he or she may appoint to represent him or her for the purpose of this Constitution;

"Chief Finance Officer" - the Section 151 Officer appointed by the Council, the Head of Finance;

"Chief Officers" - the Chief Executive or the Corporate Directors, and more specifically defined in Article 11.01(b) in part 2 of this Constitution.

"confidential" - information given to the Council by a Government Department on terms which forbid its public disclosure or information which cannot be publicly disclosed by court Order, or by virtue of any enactment as defined in the Access to Information Rules 10.03;

"committee" - a committee of the authority;

"Council" - the South Holland District Council;

"day" - a working day, i.e. excluding Saturday, Sunday and bank and public holidays;

"employee" - an employee of the authority or the holder of a paid office under the authority other than the chairman or vice-chairman or where the payment is made in accordance with the Scheme for Payment of Members' Allowances.

"exempt" - as defined by Schedule 12A of the 1972 Act and Article 10.04 of the Access to Information Rules in Part 4, Section 2 of the Constitution.

"executive functions" - functions which may be discharged by the Cabinet, a committee of the Cabinet, an individual member of the Cabinet, an officer or another local authority.

"forward plan" - a plan to be published by the Cabinet and updated on a monthly basis in accordance with Regulations 13 and 14 of the 2000 Regulations, setting out its programme of work in the coming 4 months.

"Head of Paid Service" - the officer appointed in accordance with Section 4 of the Local Government and Housing Act 1989, the Chief Executive;

"Heads of Service" - the nine service heads detailed in part 7 of this constitution;

"key decision" - a decision which, in relation to an executive function, has a significant effect on communities in two or more Wards of the Council and/or is likely to result in the Authority incurring expenditure, generating income or making savings in any single financial year above the threshold of £57,000 in respect of revenue expenditure and £143,000 in respect of capital expenditure (both figures are increased annually in line with RPI-x (the retail prices index excluding mortgage interest payments);

"leader of a political group" - the leader of a political group as defined in the Local Government (Committee etc.) Regulations 1990;

"leader" - such person as the council shall so elect to be leader of the Cabinet in accordance with Council Procedural Rule 1.1(vi);

"local choice functions" - as defined by Regulation 3 and Schedule 2 to the Local Authority (Functions and Responsibilities) (England) Regulations 2000, where the Authority has decided which functions are to be the responsibility of the Cabinet;

"meeting" - a meeting of the council, Cabinet, a committee, the Policy Development Panel, the Performance Monitoring Panel or sub- committees or Task-Groups as the case may be;

"member" - in relation to the council, a member of the council; in relation to any other body a person appointed as a member of that body, whether or not entitled to vote;

"monitoring officer" - the officer appointed in accordance with section 5 of the Local Government and Housing Act 1989, the Head of Customer, Legal and Member Services or, if he or she is unable to act owing to absence or illness, the person nominated as his or her deputy;

"number of members" - in relation to the council, the number of persons who may act at the time in question as members of the council and in relation to any other body, the numbers of persons who may act at the time in question as voting members of that body;

"overview and scrutiny committees" - committees of the Council established in accordance with Section 21 of the Local Government Act 2000, the Policy Development Panel and the Performance Monitoring Panel and any Task-Groups appointed by them;

"Performance Monitoring Panel" - an overview and scrutiny committee of the council established in accordance with Section 21 of the 2000 Act.

"person presiding" - the person entitled, or appointed, to preside at any meeting;

"Policy Development Panel" - an overview and scrutiny committee of the Council established in accordance with Section 21 of the 2000 Act;

"political balance rules" - as defined in the Local Government and Housing Act 1989 relating to proportional representation; on Panels, committees, sub-committees and certain other bodies.

"political groups" - a political group as defined in the Local Government (Committees etc) Regulations 1990 or any statutory modification or re-enactment thereof;

"referendum" - as defined in the Referendum Act 2000;

"Regulatory Committee" - a committee undertaking "quasi-judicial" functions of the Council (such as licensing and development control);

"Service Delivery Team" - collectively the nine Heads of Service detailed in part 7 of this constitution;

"Senior Management Team" - collectively the Chief Executive, the Corporate Directors, the Head of Planning and Development, and the Head of Organisational Development;

"the 1972 Act" - the Local Government Act 1972;

"the 1989 Act" - the Local Government and Housing Act 1989;

"the 2000 Act" - the Local Government Act 2000;

"vice-chairman" - the person appointed to preside, in the absence of the chairman, at meetings of any properly constituted body.
