"Expedited Call-In Procedure
1. Any Councillor who is not a member of the Executive may at any time make a request in writing to the Proper Officer to call in a decision which has been made by the Cabinet, by a member of the Executive or by an officer on behalf of the Cabinet.
2. Upon receipt of such request, the Proper Officer shall, as soon as reasonably practicable after receipt of the request, decide whether to effect an expedited Call-In. In making this decision, the Proper Officer shall refuse such a request if the request:
a. does not relate to an executive decision which has been made but not yet implemented;
b. is trivial, vexatious or repetitious;
c. appears to him to be otherwise improper; or
d. he has already acceded to 4 or more requests for expedited Call-In from the Councillor making the request within the same civic year.
3. Where the Proper Officer decides to effect an expedited Call-In, he shall forthwith notify in writing:
a. the Councillor making the request;
b. the Leader of the Council;
c. the executive member or officer (if any) who took the decision which is the subject of the Call-in;
d. the executive member within whose Portfolio the decision which is the subject of the Call-In falls;
e. the Chief Officer within whose service responsibilities the decision which is the subject of the Call-In falls; and
4. Such notification shall act as a request to the Chief Officer within whose service responsibilities the decision which is the subject of the Call-In falls to suspend any implementation of the decision until the decision has been reconsidered under this procedure. However, the Chief Officer may implement the decision notwithstanding this request where, after consultation with the relevant executive member within whose Portfolio the decision which is the subject of the Call-In falls, he is of the opinion that the suspension of implementation of the decision would cause unacceptable damage or risk of damage to the interests of the authority or of the authority's area or inhabitants.
5. Where the Proper Officer decides not to effect an expedited Call-In, he shall as soon as reasonably practicable notify his decision in writing to the Councillor making the request.
6. Where the Proper Officer receives a request for an expedited Call-In, he shall report all such requests to the next convenient meeting of the Performance Monitoring Panel, together with any reasons for not effecting an expedited Call-In, whereupon the Panel may:
a. note the decision of the Proper Officer;
b. resolve to call in the executive decision which was the subject of the request; or
c. resolve to review the executive decision which was the subject of the request.
7. Definitions
a. "Civic year" means the period from one Annual Meeting of the Council until the next Annual Meeting.
b. "In writing" means by letter, fax or email delivered to the Proper Officer.
c. "Proper Officer" means the Head of Customer, Legal and Member Services.
