Delegation to Portfolio Holders
Introductory note:
Any decision that is made by a Portfolio Holder is subject to an initial report, and a subsequent decision which must be published in writing by the Head of Customer, Legal and Member Services. Certain decisions are known as 'Key Decisions' because they have a significant impact on the community, or because they can result in costs or savings of £57,000 revenue or £143,000 capital. These decisions can only be taken if they have been advertised in the Council's Forward Plan. Councillors can 'call-in' any Portfolio Holder decision if they are unhappy with it - if a decision is called in, then it cannot be implemented until it has been scrutinised by the Council's Performance Monitoring Panel and sometimes by the full Council as well.
All Portfolio Holders
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- Consultation paper responses - allocated to the appropriate Portfolio Holder depending upon the subject of the consultation (except for consultation on matters of some gravity, or constitutional matters, which must be reported to the Cabinet as a whole, at the request of the Portfolio Holder)
- Anything else falling broadly within the remit of the member's portfolio
Portfolio holder for economic development, risk management, audit, and waste & cleansing
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- Grant funding or match funding contributions to economic development projects
- Collection and disposal of septic tank and pail closet contents
- Foul and/or surface water sewerage, drainage and sewage disposal
- Refuse collection, refuse disposal and litter prevention
- Anything else that is broadly within the remit of the portfolio
Portfolio holder for operational staffing, community strategy, co-ordination of outside bodies, promotion of local democracy, and crime reduction
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- Approval of crime/security projects and funding
- Community grants within an identified grants budget
- Provision of district wide events (horticultural and gardening)
- Community projects
- Anything else that is broadly within the remit of the portfolio
Portfolio holder for operational housing, tenant participation, Supporting People, and housing options appraisal
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- The obligations, powers and responsibilities devolving upon the Council under the provisions of the Housing Act 1985, and all subordinate and all other or subsequent legislation on housing matters and in particular on:
- Housing needs and welfare of the inhabitants of the district
- Provision and maintenance of dwellings and their allocation
- The administration of rents and associated functions
- Improvement of houses or areas of dwellings in the district
- Tenant Participation matters
- Grants under the Housing Grants, Construction and Regeneration Act 1996 - consideration of exceptions to policy (policy set out in minute 28/97)
- Approval of grants under the Housing Grants, Construction and Regeneration Act 1996 in accordance with budgetary and mandatory requirements
- Determination of payments towards electricity bills of tenants in mobile homes during modernisation works, where case falls outside of policy
- Abatement of overcrowding and the clearance, closure or otherwise remedying of housing unfit for habitation or in defective condition
- Allocation of Homelessness Grant to support Council strategy and reduce homelessness
- Contractual agreement with MENCAP in preparation of Supporting People
- Anything else that is broadly within the remit of the portfolio
Portfolio holder for asset management, property management, capital programme, financial management, the budget, benefits administration, procurement, housing options appraisal, and section 106 monitoring
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- Determination of siting of electricity sub-stations (subject to consultation with Housing Portfolio Holder and Ward members)
- Determination of future garage replacement schemes (subject to consultation with Housing Portfolio Holder)
- Determination of siting of public utilities on Housing or General Fund land, and sale or lease of the land, subject to terms approved by the council's valuer and the Council's Land Sales Policy (following consultation with service Portfolio Holder and Ward members)
- Disposal or appropriation of Housing or General Fund land (including disposal of any interests in land) subject to terms approved by the Council's valuer and the Council's Land Sales Policy (following consultation with the service Portfolio Holder and Ward members)
- Approval of wayleave consents and easements (subject to consultation with service Portfolio Holder and Ward members)
- Discretionary rate relief determinations that fall outside of officer delegation
- LA SHG - annual approval of funding conditions
- Anything else that is broadly within the remit of the portfolio
Portfolio holder for improving the environment, cultural services, developing tourism, health improvement, and sport and leisure (Deputy Leader)
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- Grants to outside bodies that are involved in leisure or tourism
- Consideration of special late night Christmas shopping market, and extra/cancellation of Christmas and Flower Parade markets
- Provision and operation of markets
- Provision and maintenance of street footway lighting
- Provision and operation of cemeteries
- The provision, development and operation of leisure and recreation facilities provided by the Council and promotion of recreational events in connection therewith
- Consideration of schemes for and the determination of applications for financial assistance by way of loans and/or grants from the Physical Training and Recreation Act Fund
- Promotion of flower parade activities and tourism generally in the district
- Promotion of international understanding and goodwill generally and the further development of the present associations and links of the district and its inhabitants under town twinning arrangements in particular
- Anything else that is broadly within the remit of the portfolio
Regulatory Services
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- Street naming/renaming and numbering/renumbering where there have been objections from the Ward member or Parish Council
- Changes to Historic Building Grants scheme
- Determination of Historic Building Grant applications
- Food safety and hygiene
- Slaughter of animals
- Inspection of offices, shops, factories and other premises
- Consideration of road traffic orders
- Detection, suppression or prevention of statutory or public nuisances (other than those relating to the condition of inhabited dwellings) and pollution
- Residual planning matters, including conservation issues (with the exception of application related issues and designation of conservation areas)
- Anything else that is broadly within the remit of the portfolio
Portfolio holder for community leadership, communications with the media, housing options appraisal, partnerships, contracts, and strategic housing (Leader)
Operational decisions as detailed below in so far as (i) they are not already delegated to officers; and (ii) they are in accordance with the budget and policy framework and any other policy plan or strategy previously agreed by Cabinet or Council
- Any decision delegated to another Portfolio Holder, in that Portfolio Holder's absence.
- Awarding/terminating contracts worth in excess of £25,000.
- Anything else that is broadly within the remit of the portfolio.
