7.01 Role
The Cabinet will carry out all of the local authority's functions which are not the responsibility of any other part of the local authority, whether by law or under this Constitution.
7.02 Form and composition
The Cabinet will consist of the Leader together with between 6 and 9 councillors appointed to the Cabinet by the Leader (ie minimum size of the Cabinet is 7 members and maximum size is 10).
7.03 Leader
The Leader will be a councillor elected to the position of Leader by the Council (see Council Procedure Rule 1 - part 4, section 1). The Leader will hold office for a period of 2 years or until:
(a) he/she resigns from the office if earlier; or
(b) he/she is suspended from being a councillor under Part III of the Local Government Act 2000; or
(c) he/she is no longer a councillor; or
(d) he/she is removed from office by resolution of the Council, (as a result of criticism by the Standards Committee or conduct harmful to the Council's image); or
(e) there is a change in political control of the Council; or
(f) the regular election of councillors; or
(g) where, following resignation, removal or suspension of the Leader or change in political control a new Leader is appointed part way through the Council year, the term of office of that new Leader shall be for the remainder of the period which would have been served by the former Leader had he/she served his/her full term of office, such term of office to expire at the end of a Council year.
7.04 Other Cabinet members
Other Cabinet members shall hold office for a period of 2 years or until:
(a) they resign from office; or
(b) they are suspended from being councillors under Part III of the Local Government Act 2000 (although they may resume office at the end of the period of suspension); or
(c) they are no longer councillors; or
(d) they are removed from office by the leader who must give written notice of any removal to the Head of Customer, Legal and Member Services. The removal will take effect on the second working day after receipt of the notice by the Head of Customer, Legal and Member Services; or
(e) there is a change in political control of the Council; or
(f) the regular election of councillors; or
(g) where following resignation, removal or suspension of any member of the Cabinet or change in political control a new member of the Cabinet is appointed part way through the Council year, the term of office of that new member of the Cabinet shall be for the remainder of the period which would have been served by the former member of the Cabinet had he/she served his/her full term of office, such term of office to expire at the end of a Council year.
7.05 Proceedings of the Cabinet
Proceedings of the Cabinet shall take place in accordance with the Cabinet Procedure Rules set out in Part 4 of this Constitution.
7.06 Responsibility for functions
The Leader will maintain a list in Part 3 of this Constitution setting out which individual members of the Cabinet, committees of the Cabinet, officers or joint arrangements are responsible for the exercise of particular executive functions.
